The only LEGAL commercial music downloads will be from online music stores like iTunes, Rhapsody, and what poor, poor, sad Napster has become.
It's perfectly legal to download independent music from places like soundclick and mp3.com.
The reason file trading continues the way it does is because it IS hard to get caught doing it, especially if you're downloading music from outside your country or market. Like it's easy for an American to download Japanese music, cuz the RIAJ aren't really watching us that carefully. But if you download American music (from pretty much wherever, actually x_x cuz they're like Big Brother about it), you're more likely to get into trouble.

^agree =) and torrents have a bigger risk than direct downloads cos they seed which is the same as sharing
