This is not plagarism. The lyrics are totally different, and if he were singing the exact same lyrics, it will be likely seen as a cover. The issue here is just perhaps not mentioning any credit on whoever made the beat/instrumental.

And wow, I never heard this before, I kinda like it (except for the fact that it's really easy to make words rhyme in spanish).

It may have not been Ayumi herself, but seen this way, maybe Porta didin't take the sample himself, plus, it should be checked if he mentions her on his album...

You must credit the original artist if you sample something from them, if you don't, then it's an act of plagiarizing

Yeah, I was about to mention that. Ayu didn't do it herself, but taskinst is a blatant ripoff of that hoobastank song. I really love taskinst though. Also, there was Walking Proud = kinki kids song. But I imagine she would have had to have gotten permission at least for that one.

or if it's public material...it's not like absolutely groundbreaking piano work or something.

I like it...although its a little annoying that it's the same part over and over...

and when it changes...it's a little awkward...but I think it's interesting use, and gives an interesting flavor to the song, so I don't really care.

We can't know if it's legally sampled without seeing the credits in the booklet. But it sounds like a legit sample to me, so I don't see what the big deal is.

Anggun recently sampled "Merry Christmas Mr. Lawrence" in her song "Hymne à la vie." I haven't seen the booklet for her "Elevation" album but my guess is that it's a legal sample. Most of the time it is.

It's not plagiarism if permission has been granted. We can't know if permission has been granted until we see the credits for this song in Porta's cd booklet.

"tenshi (Angel)". The melodies are similar.

No credit is given to KK's songwriter in the "MY STORY" booklet, so my guess is that it's an accident or a coincidence. Or a ripoff, I don't know.

That's the thing, I can't remember which.

It wasn't a single though. Someone posted audio comparing the two and the vocal melodies were indeed quite similar. But since this is Japan and it's Kinki Kids, a lot of people would have noticed, that's why I'm thinking they cut some kind of deal or something.

You know copying songs or melodies is very prevalent in Asia it seems! Songs sound similar all the time... it's so weird... is that acceptable in their music industries?

As far as I know, in Japan it is not. But in China and Korea it is more or less acceptable. Maybe someone from those countries could enlighten more though. I remember there was a group that ripped off Gackt's Vanilla - they really took the entire song, put new vocals on it and claimed that they were the original composers.

I heard Tohoshinki got the rights for MIROTIC and such, but their song Lovin' you sounds JUST like Ayu's End roll... I figured since they're label mates, that was permitted as well. But in Korea there was the Hyori / Britney Spears thing...
