to be honest, i love their Japanese songs more than their Korean ones..moreover, avex gives the boys freedom to create music unlike in SM.. even though, they have released some of their self-composed songs, but most of them are only appeared in the repackage album..i want their own songs to be featured in the MAIN version..just like their Japanese album..
Well, IF ever they're under avex, i think avex will still find a way to promote them in Korea, i believe it..

but whatever it is, if they stay in SM, then SM should really be careful in handling the boys' contract.. no more slave contract..let the boys do what they want.. let them express themselves.. give them royalties!

all in all, i want the boys back on track.. perform as 5 again..

Anyway, I'm really glad the court is in favor of the boys... I think to them, getting less-than-deserved pay is secondary, to them, they really want to be treated like proper humans. As musicians, it's very cruel if their agent/company doesn't credit them or let them have patents to the songs they compose... it's something really inhumane imo, and if that is solved, I think they will be much happier.

And I really love their Korean songs lol! MIROTIC is full of sexy goodness... I love every single fast/dance song and Picture Of You is ~

Speaking of which, I'm really addicted to COLORS & Shelter now, especially Shelter!

can't agree more. The Japanese MIROTIC & "O" & Rising Sun suck! MIROTIC is still okay, but "O" feels empty; like something's missing hmm~

But the Japanese ballads really rock! I still remember how I really wanted to puke at Korean ballads like Flower Lady omg save me from that song

[News] More Info Regarding 091027 Courts Ruling On TVXQ-SME Trial

Let me summarize the current situation right now in more simple words?

1. Seoul District Court is so far favoring JaeChunSu side. They partially accepted the exclusive contract suspension the trio have been submitted. The partially accepted here so far only mentioned about the three members now can have their right to decide whether they will take one job or not. So the three members are now like 3rd parties to SM. Said that with this decision, TVXQ activities as five members will lay on three members‘ decisions, and not SM Entertainment.

2. With the point that TVXQ activities as group can still be continued, thus Court couldn’t terminate the clause about income distribution (which I’m a bit blurred here~however not in any line there’s a say that Court already deals with the unfair distribution income nor the length of contract).

3. SM is NOT YET saying anything about accepting or refusing this decision. They still said in their press release today, “About our exact official stand, we will inform it soon.”

4. The three members also have not fully agreed with the current decision. However, they’re now preparing to settle matter with SM regarding the existing payment settlement to prevent another unfair payment in the future, as well as the fact that they haven’t received any payment from SM since February this year, and another remaining issues about income distribution.

5. If both parties finally agreed with this, it’s much probable that JaeChunSu will stay at SM, yet with more independent decision rights, and — if the negotiations about income distribution runs smooth — also with more fair income distribution.

6. This is NOT final decision. As SM hasn’t said anything and the main point of this case, the income distribution is not yet solved.

In a partial provisional disposition released by the Seoul District Court, Hero, Micky and Xiah were granted the right to conduct their own solo activities. In their contract all of DBSK’s TV and film appearances, concert participation, music production, and entertainment activities were controlled by SM Entertainment. The ruling called this stipulation ‘absurd’ and gave the three members the ability to restart their individual activities (almost all of DBSK’s activities were frozen due to the lawsuit) without the interference of SM Entertainment and the ability to have a say in any group activities that SM proposes. The court also ruled that the 13 year term of the contract was too long.

hearted, hmm i don't know.. i love their Japanese O, Rising Sun, it got me hook up with DBSK because of their japanese songs, not their Korean though..
but well, i've been loving both now..but i'm more to their Japanese songs..because to me.. their Japanese songs are more versatile, unlike their Koreans are mostly just around the same type.. SMP song..even though, i love it..

In relation to Court approving partially of 3 TVXQ members’ lawsuit to terminate exclusive contract effect, SM Entertainment released their official press release today.

“SM Entertainment will give explanation of official stand related to provisional disposition application result in which 3 TVXQ members submitted. We don’t recognize all Courts decisions to be unacceptable, but there are some points in the results that we’re planning to make an immediate appeal.”

SM continued, “Also before the provisional disposition result coming out, according to Court’s request, we have to refrain from giving press release to prevent anymore confrontation. Therefore we can’t reveal the exact stand of ours as well. We will give further official info sooner or later.”

I agree, there is something lacking in the Japanese version of O Maybe because they recorded the song when their Japanese wasn't as fluent as it is now It must have been hard to record their first songs in Japanese.
